Supreme Court Warns of AI-Generated Fake Case Law

The Supreme Court has cautioned that the rise of AI-generated fake case law could fundamentally alter courtroom practice. The court observed that it would be untenable if judges were forced to verify the authenticity of every precedent cited by lawyers before deciding a case. The observation came while a Bench of Justices P S Narasimha and Alok Aradhe set aside orders passed by the National Company Law Tribunal (NCLT) and the National Consumer Disputes Redressal Commission (NCDRC). The court noted that the rise of AI-generated fake case law could lead to a situation where judges are forced to spend more time verifying the authenticity of precedents than deciding the case itself. The court has urged the government to take steps to prevent the misuse of AI-generated fake case law.
